Surgical Malpractice

Surgical Malpractice is a surgeons failure to exercise the degree of care and skill that a surgeon of the same medical specialty would use under similar circumstances. When medical “standards” are not followed and adequate treatment to patients is not provided, malpractice cases arise. If it is found that a patient has suffered an injury due to negligent surgical care, that patient should recieve money compensation for medical expenses, lost income, cost of medical care for life, lost ability to earn income or pain and suffering. In the event that a patient dies due to surgical malpractice, his or her family will be entitled to wrongful death damages which include lost income for life or mental and emotional loss.
